Rust Oleum Subsidiary Bankruptcy Battle

Judge Judith K Fitzgerald has threatened to replace lawyers with a trustee in an asbestos related bankruptcy case involving a subsidiary of RPM International, maker or Rust Oleum paint and other specialty paint products. The lawyers are arguing over which documents they are obligated to exchange in order to determine how much money will be paid out to victims of asbestos.

Asbetos particles can become lodged in a person’s lungs and cause respiratory issues, including lung cancer and mesothelioma.

Company reprentatives want to gather information about past payments made to asbestos victims in order to use a new economic model to estimate how much it will have to pay the plaintiffs. The plaintiffs attorneys are arguing that they data they are asking for includes private medical information of the plaintiffs and furthermore that the new model for determining payments is inaccurate.
